Compulsory Third‑Party (CTP) claims are specialised insurance claims designed to compensate individuals who sustain motor vehicle or car accident injuries. In short, if you’re hurt in a car, bike or pedestrian accident, CTP insurance helps pay your medical bills and lost wages.

Whether you were driving, riding as a passenger, or involved as a pedestrian, cyclist or scooter rider, a CTP claim with our car accident lawyers can cover your treatment expenses, lost wages and other related costs.

As dedicated CTP insurance lawyers on the Sunshine Coast, L&H Injury Lawyers will guide you through every step of the claims process. From preparing your paperwork to negotiating with insurers, we make it our mission to secure the compensation you deserve.

With our No Win No Fee promise, you can pursue your claim with confidence. There are no upfront costs, and you only pay us if we win your case.

Our Services

Understanding CTP Claims

CTP insurance is mandatory for all registered vehicles in Queensland and Australia wide. It provides cover for personal injuries caused by the use of a motor vehicle. Unlike other types of motor insurance, CTP insurance does not cover damage to property or vehicles – CTP insurance is all about you (your treatment, rehab and income), not fixing your car.

Our CTP claim lawyers will clarify your entitlements under the Queensland state scheme, explain the benefits available such as payments for medical treatment and rehabilitation, loss of income, loss of superannuation and care and assistance. As your CTP injury lawyers, we’ll handle the technicalities – drafting your claim form, organising medical assessments and medical evidence and liaising with insurers – so you can focus fully on your own recovery.

Eligibility for Claims with our CTP Lawyers

You may be entitled to bring a CTP claim if you:

  • Sustained injuries in a motor vehicle or car accident, whether as a driver, passenger or non‑motorist (pedestrian, cyclist, scooter rider).
  • Have incurred or expect to incur medical treatment costs, rehabilitation expenses or loss of earnings due to accident-related injuries.
  • Were not at fault, or your fault is shared but still allows for a partial recovery under Queensland’s CTP scheme.

At L&H Injury Lawyers, we will assess your situation at an obligation-free initial consultation – determining fault, identifying the correct CTP insurer, and ensuring your accident claim form is lodged promptly and accurately.

Motor vehicle accident claims can become complicated, which is why it’s important to have an experienced CTP lawyer from L&H working with you.

CTP Lawyer Sunshine Coast - FAQs

How long do I have to lodge a CTP claim?

Under the Motor Accident Insurance Act 1994 (Qld), there are strict time limits for lodging a CTP claim. In Queensland, you generally have nine months from the date of your road accident to notify the CTP insurer of your intention to claim – so don’t wait!

If you miss this deadline, you must provide a reasonable excuse for your delay however if the vehicle that was at fault for the accident cannot be identified and you miss this deadline you will be unable to bring a claim. There are also additional steps you must take immediately after the accident to identify the other vehicle in this situation. We recommend contacting us as soon as possible after your accident to ensure all time limits are met and to ensure important evidence is obtained to help prove your case.

What costs or legal fees will I incur?

L&H Injury Lawyers operates on a No Win, No Fee basis for all CTP matters. This means:

  • No upfront fees to start your claim.
  • No ongoing fees while we handle your case.
  • Legal costs are only payable from your compensation if we achieve a successful outcome.

We’ll provide you with a clear costs agreement before commencing work, so there are no surprises.

How long does the CTP claims process take?

Every CTP injury claim is unique, but typical timeframes are:

  • Early payments for treatment: as early as 2 weeks after lodgement of your claim form
  • Settlement negotiations: 12 – 18 months after your accident depending on the complexity of your injuries
  • Court proceedings (if required): potentially 2+ years from lodgement

It is important to seek legal advice from our experienced CTP lawyers who understand the intricacies of making CTP insurance claims. Throughout the process, we’ll keep you updated on progress and work to speed-up any interim payments you need for treatment and rehabilitation.

What types of CTP compensation payments can I claim?

Under the Queensland CTP scheme, when there has been a car crash or motor vehicle incident, the at‑fault vehicle’s insurance company is obliged to provide a range of CTP compensation payments, including:

  • Personal injury benefits such as weekly loss of earnings, care and domestic assistance
  • Medical and rehabilitation expenses (treatment, therapy and specialist reports)
  • Lump sum payments for permanent impairment and non‑economic loss (pain and suffering)

When you claim compensation, one of our experienced CTP claims lawyers will assess your individual circumstances and losses to ensure you receive full and fair compensation.

Can I claim compensation for psychological damage?

Yes. Under the Queensland CTP scheme, you can claim for psychological damage, including post‑traumatic stress disorder (PTSD), anxiety, depression and other mental health conditions directly resulting from your motor vehicle accident.

When you lodge your claim, our team will:

  • Obtain comprehensive psychiatric or psychological assessments to establish the nature and extent of your psychological injuries.
  • Include medical and rehabilitation expenses for therapy, counselling and specialist treatment in your personal injury benefits.
  • Pursue lump sum payments for non‑economic loss (pain and suffering) where your psychological impairment is demonstrable and ongoing.

At L&H Injury Lawyers, we ensure your claim captures both the physical and psychological impacts of your accident, negotiating with the insurer to secure the full CTP compensation payments you’re entitled to.
